The law of negligence is based on the leading 1932 case of Donaghue v. Stevenson in which the House of Lords decided that everyone has a duty of care to ensure that they act in a way which avoids causing damage to other people wherever it would be reasonably foreseeable to a reasonable person that the damage might result. Anyone who fails in this duty is negligent and can be sued by the damaged party for compensation.
